Divorce Attorneys Portland OR – Do Prenuptial Agreements Always Hold Up in Court?

July 25th, 2014

Of course, prenuptial agreements are not a new topic. So why do we mention prenuptial agreements so often? The reason: although we know that prenuptial agreements can be a touchy subject, we also know that by having them in place, people can save themselves a lot of headaches down the road, should their marriage end in divorce.

However, it’s important to realize that although prenuptial agreements are very useful when it comes to settling a divorce, they do not always stand up in court if they have not been done properly. For example, if the court feels a prenuptial agreement is unfair then the judge could change the parameters and alter the settlement.

In other words, if there is a huge difference between the existing agreement and what the court would do if there were no agreement, then the judge might decide to change things. Other factors a judge might consider are the timing of the agreement and whether or not one or both of the parties signed it under duress.
