In legal jargon, divorce is known as a “dissolution of marriage.” In Oregon, either spouse can file a petition for a “no fault” divorce. Once filed, the court takes over and has the power to rule on a plethora of matters including child custody, parenting time, child support, division of property, and debt.
Courts will consider several issues before awarding spousal support. Those issues include the length of the marriage, the financial needs of each party, child custody, tax consequences, and other key issues. Spousal support can be awarded on a temporary or permanent basis, depending on the circumstances.
When it comes to child custody cases, Oregon courts generally rule in the “best interests of the child.”
Joint custody is only awarded if both parents can agree to the arrangement. Also, every custody order comes with a parenting time plan. In Oregon, the term “parenting time” is used in lieu of “visitation”.
